4. Quotations Are Not Automatically Confirmed Orders

A request for quotation, enquiry, WhatsApp message, email, telephone conversation, or online form submission does not automatically constitute a confirmed order.

An order becomes binding only after confirmation by Panwar Enterprises through an appropriate written commercial communication, invoice, purchase order acceptance, or other authorized confirmation.

Quotations may have a stated validity period. If no validity period is specified, Panwar Enterprises may revise the quotation based on component availability, supplier pricing, taxes, logistics costs, exchange-rate changes, or other relevant commercial factors.

5. Customer Information and Identity

Customers must provide accurate, complete, and current information when requesting quotations, placing orders, or communicating with Panwar Enterprises.

This may include the customer's name, business information, billing information, delivery information, telephone number, email address, GST information where applicable, and other information reasonably required to process an order.

Panwar Enterprises may request additional information or verification where an order appears suspicious, inconsistent, unusually high-risk, or potentially fraudulent.

6. Fraud Prevention and Suspicious Transactions

Panwar Enterprises maintains the right to delay, reject, suspend, cancel, or investigate any enquiry, order, payment, or transaction where there are reasonable grounds to suspect fraud, impersonation, identity misuse, payment fraud, stolen payment instruments, false documentation, unauthorized transactions, manipulation, or other unlawful activity.

Suspicious activity may include, without limitation:

  • False or misleading customer information.
  • Impersonation of another person or organization.
  • Use of unauthorized payment methods.
  • False payment confirmations or forged documents.
  • Attempts to manipulate quotations or invoices.
  • Fraudulent warranty or replacement claims.
  • Unauthorized chargebacks or payment disputes.
  • Repeated suspicious orders or cancellations.
  • Attempts to obtain products through deception.
  • Any activity reasonably suspected to violate applicable law.

7. Fraudulent Conduct and Legal Action

Where Panwar Enterprises reasonably believes that a customer or third party has engaged in fraudulent, deceptive, dishonest, abusive, or unlawful conduct, Panwar Enterprises reserves the right to take appropriate action, including cancellation of transactions, suspension of service, retention of relevant records, recovery of legitimate losses, and reporting the matter to appropriate authorities where legally appropriate.

Nothing in these Terms prevents Panwar Enterprises from pursuing any lawful remedy available under applicable law.

8. Payments

Customers are responsible for making payments through authorized payment channels communicated by Panwar Enterprises.

Customers must not submit false payment confirmations, manipulated screenshots, forged transaction references, or otherwise misrepresent the status of a payment.

Panwar Enterprises may wait for payment clearance and verification before beginning procurement, assembly, configuration, dispatch, installation, or other work.

9. Unauthorized Chargebacks and Payment Disputes

Customers should contact Panwar Enterprises directly before initiating a payment dispute where a legitimate commercial issue can reasonably be resolved through communication.

A customer must not knowingly initiate a false, fraudulent, misleading, or unauthorized chargeback or payment dispute after receiving products or services.

Where a payment dispute appears fraudulent or inconsistent with transaction records, Panwar Enterprises may provide relevant transaction records, invoices, communications, delivery records, serial numbers, photographs, or other legitimate evidence to the applicable payment provider, financial institution, platform, or competent authority.

10. Custom-Built Systems

Custom-built computers, servers, workstations, storage systems, and infrastructure may be assembled specifically according to the customer's approved requirements.

Customers are responsible for reviewing and approving the proposed configuration before procurement or assembly begins.

Once procurement, assembly, customization, configuration, or deployment has commenced, cancellation or modification may be restricted and may result in applicable costs, subject always to rights that cannot legally be excluded.

11. Component Substitution

Hardware components may become unavailable due to supplier constraints, discontinuation, stock limitations, or market conditions.

Where an equivalent or improved component is required, Panwar Enterprises may propose a suitable alternative for customer approval before implementation.

12. Delivery and Inspection

Customers are responsible for providing accurate delivery information and ensuring that someone authorized is available to receive the shipment where required.

Customers should inspect packaging and products promptly after delivery and notify Panwar Enterprises of any apparent transit damage or discrepancy within a reasonable period.

Delivery timelines are estimates unless a specific delivery commitment has been expressly confirmed in writing.

13. Installation and Customer Responsibilities

Customers are responsible for providing suitable electrical, environmental, networking, physical, and operational conditions for equipment unless installation and infrastructure requirements are expressly included in the applicable service agreement.

Customers must follow reasonable installation, operation, maintenance, ventilation, power, and safety instructions.

14. Warranty

Hardware warranty coverage is subject to the applicable manufacturer's warranty and/or the specific warranty terms communicated with the product or quotation.

Warranty coverage may be affected by misuse, physical damage, liquid damage, electrical damage, unauthorized modification, tampering, incorrect installation, improper cooling, overclocking, accidental damage, or other conditions excluded by the applicable warranty.

Customers should retain invoices, serial numbers, warranty documentation, and other relevant purchase records.

15. Software and Customer Data

Customers are responsible for maintaining appropriate backups of their data before hardware servicing, repairs, installations, migrations, upgrades, or other technical work.

Unless expressly agreed otherwise in writing, Panwar Enterprises does not guarantee preservation of customer data during hardware servicing, operating system installation, configuration, troubleshooting, migration, or repair.

Customers are responsible for ensuring that software, operating systems, licenses, datasets, models, and other digital resources used on supplied equipment are lawfully obtained and used.

16. AI, GPU and High-Performance Computing

Performance of AI, GPU, rendering, scientific computing, gaming, virtualization, storage, and other workloads depends on software, workload characteristics, datasets, configuration, environmental conditions, and other factors.

Hardware specifications should not be interpreted as a guarantee of a particular application benchmark, productivity level, model-training time, inference speed, gaming frame rate, or business outcome unless expressly confirmed in writing.

17. Prohibited Use

Customers must not use products, services, or website resources for unlawful activities, unauthorized access, malicious activity, fraud, harassment, abuse, infringement, or activities prohibited by applicable law.

Panwar Enterprises may refuse service where it reasonably believes that a proposed use presents significant legal, security, safety, or compliance concerns.

18. Website Security and Abuse

Users must not attempt to compromise, disrupt, reverse engineer, overload, scrape improperly, gain unauthorized access to, or interfere with the security or operation of the website or its infrastructure.

19. Intellectual Property

22. Third-Party Manufacturers and Services

Certain products and components may be manufactured by third parties. Manufacturer trademarks, warranties, specifications, software, and services remain subject to their respective owners' terms and policies.

23. Force Majeure

Panwar Enterprises shall not be responsible for delays or inability to perform caused by circumstances beyond reasonable control, including natural disasters, fire, flood, epidemic, war, government action, transportation disruption, supplier failure, power disruption, network failure, strikes, or significant market or supply-chain disruption.
